On Tuesday, November 16, 2021, the United States Trade Representative (USTR) office in Federal Register Notice 86 No 218 FR 63438 stated that the Section 301 Exclusions for 99 Covid-19 related medical supplies originally scheduled to expire on November 14, 2021, would be extended through November 30, 2021, and that 81 items would be extended for an additional six months to May 31, 2022.
The original 99 exclusions which are being extended until November 30, 2021, can be found here on the USTR December 29th COVID-19 Exclusion Notice. The additional 81 items which will be extended until May 31, 2022, can be found in Annex B of this federal register notice.
Companies are encouraged to refer to the Annex in the November notice to determine if any of their products are included in the specifically identified exclusion extensions. The scope of each exclusion extension is governed by the 10-digit level HTS numbers and the descriptions identified in the notice. It is important to note that these exclusions are available for any product that meets the description in the official notice, regardless of whether the importer filed an exclusion request. If you import products that are consistent with these descriptions, you will be able to claim an exclusion extension using HTS# 9903.88.66 effective December 1, 2021.
