On Wednesday, March 10, 2021, the United States Trade Representative Office (USTR) announced in Federal Register Notice 86 No 45 FR 13785 that the Section 301 exclusions for Covid-19 related medical supplies, originally scheduled to expire on March 31, 2021, would be extended through September 30, 2021.
The ninety-nine exclusions can be found here on the USTR December 29th COVID-19 Exclusion Notice. Companies are encouraged to refer to the Annex in the December notice to determine if any of their products are included in the specifically identified exclusion extensions. The scope of each exclusion extension is governed by the 10-digit level HTS numbers and the descriptions identified in the notice. It is important to note, that these exclusions are available for any product that meets the description in the official notice, regardless of whether the importer filed an exclusion request. If you import products that are consistent with these descriptions, you will be able to claim an exclusion extension using one of the four designated headings in the annex: 9903.88.62, 9903.88.63, 9903.88.64, and 9903.88.65, effective through September 30, 2021.
