On Thursday, August 29, 2019, the United States Trade Representative (USTR) issued a request for comments concerning Section 301 actions. This comment period is specific to the increase in tariffs from 25 percent to 30 percent for Section 301 Lists 1-3 valued at $250 billion previously announced in the USTR Statement on Section 301 Tariff Action Regarding China. These new tariffs are set to increase on October 1, 2019.
The comment period deadline is September 20, 2019.
Written comments should be submitted through the federal portal, https://www.regulations.gov/. The docket number is USTR-2019-0015. Any comments containing business confidential information (BCI) should be submitted via email to: 301bcisubmissions@ustr.eop.gov.
Commenters are being asked to specifically address whether increasing the tariff rate would:
- be practicable or effective to obtain the elimination of China’s acts, policies and practices related to technology transfer, intellectual property and innovation, which are harming and restricting U.S. Commerce.
- cause disproportionate economic harm to U.S. interests, including small-or medium-sized businesses and consumers.
