On Friday, May 31, 2019, the United States Trade Representative announced that they intend to publish a notice in the Federal Register that “extends the amount of time certain goods exported from China have to enter the United States before they will be subject to an additional tariff increase from 10 percent to 25 percent.”
Effective Date Specifics
According to the U.S. Customs and Border Protection (CBP), CSMS # 19-000274:
- Covered products that were exported from China to the United States prior to May 10, 2019, will remain subject to an additional 10 percent tariff if they are entered for consumption in the U.S. before June 15, 2019.
The original deadline established by the CBP was June 1, 2019. This date has not yet been updated in the Automated Commercial Environment. Importers entering subject goods on or after June 1, 2019, which were exported before May 10, 2019, and would be affected by this change, should consider waiting to file the entry summary pursuant to the ten-day entry summary filing period. This will allow the CBP time to make the changes.
Entry Filing Specifics:
- For goods exported from China to the United States before May 10, 2019, and entered for consumption, or withdrawn from warehouse for consumption on or after 12:01am EDT on May 10, 2019, and before June 15, 2019, report HTS number 9903.88.09 and pay the 10 percent duty rate.
- For goods exported from China to the United States on or after May 10, 2019, and entered for consumption, or withdrawn from warehouse for consumption on or after 12:01am EDT on May 10, 2019, report the HTS numbers 9903.88.03 and 9903.88.04 and pay the 25 percent duty rate.
- Goods entered into the United States on or after June 15, 2019, are subject to the 25 percent duty rate and are to be reported under HTS numbers 9903.88.03 and 9903.88.04.
